FAMILY COSTUME CONTEST
Disclaimer:
ASSUMPTION OF RISK, RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNIFICATION AGREEMENT
By registering for, entering, attending, or participating in the Dad Games Halloween Celebration (the “Event”), I acknowledge and agree, on behalf of myself and, to the extent permitted by applicable law, any minor children or dependents accompanying me, to the following terms:
1. Assumption of Risk: I understand that attendance and participation in the Event may involve inherent and unforeseen risks, including, but not limited to, bodily injury, illness, death, property loss or damage, accidents, slips, falls, crowd-related incidents, food-related reactions, interactions with other attendees, equipment or activity-related injuries, weather conditions, natural disasters, acts of God, emergencies, and the acts or omissions of third parties. I knowingly and voluntarily assume all such risks, whether foreseeable or unforeseeable, to the fullest extent permitted by law.
2. Release and Waiver of Liability: To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and covenant not to sue Dad Games, Capital Turnaround, the Event organizers, presenting and participating sponsors, partners, vendors, affiliates, property owners, officers, directors, employees, agents, contractors, representatives, and volunteers (collectively, the “Released Parties”) from claims, demands, damages, losses, liabilities, costs, and causes of action arising from or relating to my attendance or participation in the Event, including claims involving ordinary negligence to the extent such claims may lawfully be released. This release does not apply to claims that cannot legally be waived.
3. Responsibility for Minors: As the parent or legal guardian of any minor child attending with me, I acknowledge that I am responsible for the child’s supervision, conduct, safety, and well-being throughout the Event. I understand that the Event organizers do not assume responsibility for providing individual childcare or supervision. I consent to the minor’s participation and acknowledge the risks described in this Agreement. I agree to these terms on my own behalf and, only to the extent legally permissible, on behalf of the minor.
4. Indemnification and Hold Harmless: To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless the Released Parties against third-party claims, damages, liabilities, and reasonable legal expenses arising from my own negligent, reckless, or intentional acts or omissions, my violation of Event rules, or damage or injury caused by me. This provision does not require indemnification for conduct of the Released Parties where prohibited by applicable law.
5. Uncontrollable Events: I acknowledge that the Released Parties cannot guarantee protection against circumstances beyond their reasonable control, including severe weather, natural disasters, public emergencies, utility failures, government actions, or acts of God. I accept the risks associated with such circumstances, subject to applicable law.
6. Emergency Medical Assistance: In the event of an emergency, I authorize Event personnel to contact emergency medical services for me or my accompanying minor children when reasonably necessary. I understand that I remain responsible for medical expenses incurred, except where otherwise required by law.
7. Acknowledgment and Agreement: I certify that I am at least 18 years of age, have read and understand this Agreement, and voluntarily accept its terms. If registering minor children, I certify that I am their parent or legal guardian or otherwise possess the legal authority required to register them.
By selecting the acknowledgment checkbox and submitting my registration, I intend to provide my electronic signature and agree to be bound by this Agreement to the extent enforceable under applicable law.
